Three Vail pricing-related lawsuits: what each case actually alleges

Coverage reviewed September 28, 2026. Three different 2026 proceedings raise questions about ski pricing and corporate oversight. They are allegations, not findings that Vail broke the law. The cases should not be described as three identical consumer class actions.

1. Goloja: consumer bundling challenge. Filed March 23, 2026 in Colorado federal court (1:26-cv-01191), this proposed class action challenges Vail and Alterra pass and lift-ticket practices. Plaintiffs allege unlawful tying and penalty pricing that push customers toward multi-resort passes. The theory concerns the operators’ respective conduct; it should not be confused with the later information-sharing suit.

2. Green: alleged information sharing. Filed August 5, 2026 (1:26-cv-03555), this separate consumer case alleges that Vail, Alterra, Boyne and Powdr used competitively sensitive information shared through industry participants to coordinate pricing. RRC Associates and the National Ski Areas Association are also named. These remain the plaintiffs’ allegations.

3. Peterson: shareholder derivative complaint. Filed August 24, 2026 (1:26-cv-03889), Gary Peterson’s complaint is brought derivatively on behalf of Vail against directors, with Vail named as a nominal defendant. It alleges securities-law violations, breaches of fiduciary duty and unjust enrichment connected to oversight and disclosures. The complaint labels itself a stockholder derivative action, rather than a third consumer class action.

Courthouse News brought the three proceedings together in its coverage. Vail told the outlet that it considered the claims without merit and would defend vigorously. This overview explains the filings; it does not establish the latest procedural status or a merits ruling in any case.

Why this matters: the consumer cases challenge different pricing practices, while the shareholder case focuses on directors’ duties. A filed complaint is not a judgment, and no refund entitlement or liability is established by this summary.
